CC&R's

When our Village Homes North development was built, Covenants, Conditions and Restrictions (CC&R's) were recorded with each home.  These are rules that outline (among other things) how the association conducts business, how common areas are managed and rules that all homeowners must abide by.  Homeowners that fail to abide by a rule are sent a warning letter.  This letter should be viewed as a friendly notice to correct a problem.  Simply correcting the violation is the only action necessary on your part.  (Click here for a sample of a this notice.) 

Homeowners are free to report violations to our management company, however, we understand that many people do not want the job of "policing" their neighborhood.  For this reason, the board has directed our management company to conduct periodic CC&R tours.  The board is not normally involved in these tours, however, occasionally the board will accompany our management company to ensure our CC&R's are being consistently and properly enforced.  The tours help keep our neighborhood looking nice, and may help keep our property values higher than other areas.

For minor violations that are easily correctable (such as children's toys left on a lawn), the board has directed our management company to simply note the homeowners file and send no warning.  This is done with the intent to minimize notices that are sent out, and also not to bother with an issue that may have been in violation for a very short period of time.  If the same violation is seen at the same home at a future date, this shows an ongoing problem and a notice will be sent at that time.

If a violation is not corrected in a reasonable period of time (two weeks) or if the same violation occurs again, additional notices will be sent.  These notices are more strongly worded.  (Click here for a sample of the second violation notice and click here for a sample of the third violation notice.)  If you receive one of these notices, you may wish to contact Crown Management if you need more specifics on the exact nature of the violation. 

If you have a compelling reason why you cannot correct the problem right away or if you plan to correct the problem in the future, you should also contact Crown Management.  For example, if your trim needs painting and you have been sick, or if you plan to paint your trim within two months, please let Crown Management know.  The Board of Directors is happy to work with homeowners and grant an extension, so long as the issue is corrected within a reasonable amount of time.  This is at the sole discretion of the board, and will vary depending on the reason, length of time to correct and the nature of the violation.

If a homeowner fails to correct a violation, additional action will be taken.  The Board sincerely wishes to avoid this, however they have a legal responsibility to uphold the association CC&R's.  If a violation remains uncorrected after a third notice is sent, a notice is sent to the homeowner indicating they are being called to a hearing.  The hearing is held by two board members, generally at the offices of Crown Management.  The homeowner is given an opportunity to present the reasons why they have not corrected a violation or why they feel a violation has been corrected.  The board members then decide what action to take.  Such action can include deciding a violation does not or no longer exists, allowing the homeowner additional time to correct a violation or imposing a fine on the homeowner (in accordance with our fine policy). 

Additional action can be taken for violations that remain uncorrected.  Additional and larger fines can be imposed and/or a lien can be placed on the homeowners property.  Our legal counsel can also become involved in a situation such as this.  It is the Village Homes North policy that our attorney's fees are charged to the violating homeowners account.

Thankfully, it is rarely necessary for such action to be taken.  Also, a homeowner should not wait to be called to a hearing to explain their side of a CC&R violation.  Communications can be sent anytime to the Board via Crown Management
